Applying for trademark/ Registration procedure

¡ÚTypical case¡ÛThe basic flow of applying for trademark/registration procedure
A brewer company X (client) would like to put label ¡ÈTAGO¡É on the new brand of shochu and sell it in Japan. This is the case in which X wishes to do something to prevent other brewer companies to use the name ¡ÈTAGO¡É in advance.

¡ÚInvestigating on trademark¡Û
First, you need to investigate on trademark and confirm that the trademark ¡ÈTAGO¡É is not used anywhere (including trademarks that look like the trademark concerned externally and conceptually). If other companies have already registered for the trademark, you need to judge whether ¡ÈTAGO¡É is able to be registered, by checking designated products and similar products include the key word ¡Èshochu.¡É (In case the trademark has not been used for a long time, you may petition a judgment to cancel the right of trademark, even if ¡ÈTAGO¡É is registered as a designated product to indicate ¡Èshochu.¡É
¡ÚApplying¡Û
In case ¡ÈTAGO¡É is viewed as a trademark that is possible to register, you need to consider product category and which is the most efficient to designate, before submitting the document. (Because revenue stamp costs 8,600 JPY per each product category and the registration fee costs 37,600 JPY, you need to consider well beforehand.)
¡ÚInvestigating¡Û
At the Patent Office, substantial investigation of the trademark ¡ÈTAGO¡É will take place, whether the applicant has intention to use the trademark concerned and the trademark¡Çs discrimination ability, etc.
¡ÚOpinion¡Û¡ÚRevision¡Û
In case the notice of rejection is submitted by the Patent Office during the process of investigation, you will work to improve the reason of rejection by submitting opinion or revision. (a partial removal of designated product) If rejected assessment was submitted, you may petition a lawsuit of cancelling the judgment of the Patent Office.
¡ÚRegistration¡Û
In case the registration assessment is submitted, the trademark will be registered on the original register after the payment and the process of registration of trademark is completed. (However, you need to renew the registration for every 10 year.) Moreover, statistically speaking, it seems to take about 6 (six) months from applying to registering.
